Terms & Conditions

By using GoWaaS you agree to these terms. This is a business-to-business agreement for clients in the United States, written the way we actually talk. Together with any signed order form, it forms the complete agreement between you and GoWaaS.

What we do

GoWaaS designs, builds, hosts, and maintains your business website. Depending on your plan, we also provide the Growth Engine: a set of communication and automation services that may include a business tracking phone number, missed-call text-back, automated lead follow-up by text and email, online booking, automated review requests, and a dashboard app where your leads, calls, texts, and reviews appear. Parts of the service run on established third-party platforms (for hosting, telephony, text messaging, email delivery, scheduling, and payments). We select, configure, and manage those platforms for you. Their availability is subject to their own terms and uptime.

Billing

Plans are billed in US dollars. Monthly plans renew every month; annual plans renew every 12 months with any advertised discount or free-month promotion already applied. Payment is due on the invoice date via the payment method on file. • Setup fee: a one-time fee, stated at signup, covering your website build and (on Pro) Growth Engine configuration, phone number provisioning, and carrier registration. • Included usage: your flat monthly rate includes a reasonable volume of texts, calls, and emails typical for a local trade business. If your usage is unusually high, we'll tell you first and agree on a fair adjustment before anything changes — no surprise invoices. • Prices exclude applicable taxes.

Cancel anytime

You can cancel at any time from your account or by emailing us. Cancellation takes effect at the end of your current billing period — you keep full service until then, and we do not bill you again. No exit fees, no hard feelings.

Refunds

Setup fees, monthly payments, and annual prepayments are non-refundable, including for unused time after cancellation, except where the Working Guarantee below applies or where something is genuinely broken on our side — in which case contact us and we will make it right.

The Working Guarantee (Pro plan)

If, within 30 days of your Growth Engine going live, it has not caught its first real lead, your next month of Pro service is free, and we keep working on it at no extra charge until it does. A "real lead" means any one of the following, generated by the Growth Engine and recorded in your dashboard: (a) a missed call that received an auto-text and got a reply from the caller; (b) a website or form lead that received automated follow-up and responded or booked; or (c) a review request that resulted in a published review. "Live" means your tracking number is active, carrier registration is approved, and the engine is connected to your business line. The guarantee requires that you keep the engine connected and do not disable, bypass, or block its workflows during the period.

Text messaging & communication compliance

Texting from a business number is regulated. Here's how we split the responsibility, plainly: • What we handle: we register your business number with US carriers (A2P 10DLC), configure opt-out handling (STOP/HELP), and set up your automations to follow carrier and industry messaging rules. • What you're responsible for: messages sent through your account go to your customers, so you must have a legitimate business relationship or consent to contact them, provide accurate business information for carrier registration, and never use the service for spam, cold mass-texting, or prohibited content. You are responsible for your compliance with applicable communication laws (including the TCPA) for the people you contact. We may pause messaging features if carriers flag your traffic or if usage violates these terms, and we'll work with you to resolve it.

Your business stays yours

This is Promise 03 on our site, made contractual: • Your content: text, photos, logos, and materials you give us stay yours. You grant GoWaaS the right to host and display them to run your services. • Your domain: registered in your name or transferred to you on request at any time. • Your customer data: your contact list, lead records, and conversation history are yours. On cancellation, we'll export and deliver them to you in a standard format within 14 days of your request. • Your phone number: if we provisioned a tracking number for your business, you may port it out when you leave. We will cooperate with the porting request promptly and won't hold your number hostage. (Porting requires the receiving carrier's standard process and any of their fees.) • Your reviews: reviews live on your own Google Business Profile, which you own and control. • What stays ours: our platform, source code, templates, designs, automations, and internal configurations remain GoWaaS property.

Acceptable use

Do not use the service for anything illegal, deceptive, or that infringes someone else's rights. No spam, malware, adult content, harassment, or attempts to overload or reverse-engineer the platform.

Service expectations

Apart from the Working Guarantee in Section 05, the service is provided "as is" and "as available." We aim for high uptime and quality, but we do not promise specific business results, revenue, search rankings, or 100% uptime, and third-party platforms we rely on may have their own outages beyond our control.

We may pause or end service

We may pause or terminate service for non-payment, breach of these terms, or misuse. Where reasonable, we will give notice and a chance to fix the issue first. Sections 07 (your data and number) survive termination.

Liability

To the maximum extent allowed by law, GoWaaS is not liable for indirect, incidental, or consequential damages, including lost profits or lost leads. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

Governing law & disputes

These terms are governed by the laws of the State of [STATE], USA. Disputes are resolved by binding individual arbitration administered by the American Arbitration Association (AAA) — no class actions. Before filing anything, talk to us; most problems are fixable with a phone call.

Changes to these terms

We may update these terms from time to time. If changes are material, we will let you know by email or in-app notice. Continued use of the service means you accept the updated terms.
